SYNOPSIS

Construction contracts are a species of contracts with their own peculiarities. To start off with the client has to take an “arm’s length” approach and let another party manage it for him. Additionally, a very substantial team represents him with architects, engineers with their respective specialties, quantity surveyors, interior designers, and even landscape architects involved. The complexity of construction contracts with a lot of details which may require on course correction during construction which takes a substantial length of time to deliver is another aspect. Therefore, construction contracts incorporate not only features which allow involvement by various parties during implementation but also on course corrections and mechanisms to accommodate these such as payments for variations and extensions of time, and means of resolving disputes. The talk will talk about all the above aspects.


BIODATA OF SPEAKER

Ir. Lim Eng Chong received his Bachelor’s Degree in Civil Engineering from the University of Manchester Institute of Science and Technology in 1979 and earned a Bachelor of Law Degree from the University of Wolverhampton in 1996. He passed the Certificate in Legal Practice examination and was called to the Malaysian Bar in 2003. Throughout his career, he has been involved in numerous major construction projects both as an engineer and a contracts specialist, with a total project value of approximately RM 5 billion. He also co-updated the "Building & Construction" title in Halsbury’s Laws of Malaysia, a well-regarded legal reference series published by Malayan Law Journal in 2006 and again in 2012 (though the latter edition was not published due to technical issues).
