SYMPOSIUM INFORMATION
THEME: OSHA (AMENDMENT) 2022 & FMA (REPEAL) 2022: UNDERSTANDING AND IMPLEMENTING
Factories and Machinery Act, FMA 1967 [Act 139], and Occupational Safety & Health Act 1994, OSHA [Act 514] were introduced at different periods of time for their specific objectives. The FMA was introduced 57 years ago with 13 regulations was only being amended once in 2006, whilst the self-regulatory OSHA with 7 regulations has been enforced for 28 years without any amendment. Both the Acts have 24 Regulations, 2 Orders and 8 Codes of Practice even then, there were gaps. The discrepancies on the enforcement of both OSHA and FMA between the prescriptive and self-regulations legislation has led to many legislation gaps on the enforcement of safety and health at the workplace. Over the time, this has resulted in inconsistency in the enforcement of OSH legislation, thus sometimes led to prosecution challenges for DOSH in the court of Laws. In the year of 2011 DOSH embarked on a journey to consolidate both the Acts into a single Act The OSHA (Amendment) 2022 Act was approved in Dewan Negara on the 13th December 2021. The OSHA (Amendment) 2022 & FMA (Repeal) was gazette on 16th March 2022 and the enforcement date shall take place on 1st June 2024.
Prior to the enforcement DOSH had conducted road shows on the legislation changes to enhance stakeholders understanding and preparedness for the enforcement. Both are being enforced currently, and the need to understand and implement in particular on the FMA Repeal 2022. One particular NEW clauses of the OSHA (Amendment) 2022 is on Risk Assessment. Experts in this field are here to share their experiences and provide you with steps in implementing these clauses. A forum with panelists from group of experts, speakers from industries and DOSH officials is also part of this Symposium to enhance your understanding. Participation in the seminar will better prepare attendees to adeptly integrate the latest legislative mandates, aligning with the Self-Regulatory approach and ensuring conformity with the OSH (Amendment) Act 2022.
